1 Introduction

1.1 Welcome to the Vinted Platform (hereinafter referred to as "this Platform"). Before using the Vinted Platform, opening a Vinted account (hereinafter referred to as an "Account"), or opening a Vinted shop (hereinafter referred to as a "Shop"), please read these Terms of Service carefully to understand your legal rights and obligations regarding Vinted (individually and collectively referred to as "Vinted," "we," or "our"). The services we provide (hereinafter referred to as "the Services") include: (1) this Platform (including mobile applications); (2) the services provided by this Platform and Vinted client software; and (3) all information, linked web pages, features, data, text, images, photographs, graphics, music, sounds, videos, messages, tags, content, programming, software, and application services (including, but not limited to, any mobile application services) provided through this Platform or its related services (hereinafter referred to as "Content"). Any new or upgraded features of the Services shall also be subject to these Terms of Service. These Terms of Service govern your use of the services provided by Vinted.

1.2 Vinted Policies: Various terms or conditions applicable to sellers that are published on the Vinted Platform and updated from time to time, including, but not limited to, the Cross-Border Seller Terms of Service, Privacy Policy, Prohibited and Restricted Items Policy, Vinted Logistics Service Terms, policies and terms set forth in the Seller Center, and various policies and terms that may be newly released in the future. Unless otherwise expressly provided in these Terms of Service, the definitions and interpretations of terms contained within the Vinted Policies shall apply to these Terms of Service.

1.3 Vinted Platform: Refers to the websites and mobile shopping applications provided and operated by Vinted, including, but not limited to, Vinted shopping websites and mobile shopping clients globally.

1.4 By using the Services or by opening an Account and Shop on this Platform, you irrevocably accept and agree to these Terms of Service, including any additional terms and policies referenced herein or accessible via links provided within these Terms of Service. Furthermore, you remain obligated to simultaneously comply with the Terms of Service and rules of the specific site platform corresponding to the country/region where you have opened your Shop; your acceptance of and agreement to these Terms of Service does not exempt you from the obligation to read and comply with the Terms of Service of the specific site platform where your Shop is located. In the event of any conflict between these Terms of Service and the terms of service of the specific site platform where you have established your shop, the terms of service of that specific site platform shall prevail.

If you have entered into a separate written agreement with us regarding specific services, and a conflict arises between the terms of that separate written agreement and these Terms of Service, the terms of the separate written agreement shall prevail.

1.5 This Service comprises the provision of an online platform service that offers a venue and opportunities for the trading of goods by sellers (hereinafter referred to as "You," "User," or "Seller"). The actual sales contract exists solely between the buyer (hereinafter referred to as "Buyer") and the seller; Vinted is not a party to such sales contracts or any other agreements between buyers and sellers, and Vinted assumes no obligations whatsoever with respect to such contracts. Buyers and sellers shall bear full responsibility for all matters pertaining to sales contracts, product listings, purchase guarantees, and similar issues arising from their use of the Vinted Service. Vinted does not participate in transactions between users. Vinted reserves the right to pre-screen users or the content and information provided by users. TikTok Shop reserves the right, pursuant to Clause 6.5, to remove any content or information provided by you through this Platform. Vinted cannot guarantee that users will actually complete their transactions.

1.6 Prior to becoming a user of this Service, you must read and accept all terms and conditions contained within, or linked to, these Terms of Service; furthermore, you must agree to the provisions set forth in the Privacy Policy regarding the processing of personal data belonging to sellers and buyers (where applicable).

1.7 From the moment you become a user of this Service, should you violate these Terms of Service or any other rules and policies with which you are required to comply (including, but not limited to, additional terms referenced herein or provided via links within these Terms of Service, as well as Vinted's specific policies), Vinted reserves the right to take appropriate action against you—as well as against the accounts and shops you have established on this Platform—in accordance with these Terms of Service and the relevant rules and policies (including, but not limited to, the range of disciplinary actions described in Clause 7.1 of these Terms of Service). You hereby undertake and agree to accept such actions taken by Vinted and to bear all corresponding liabilities.

2 Privacy

2.1 Vinted places great importance on the protection of privacy; we have detailed our specific practices regarding privacy protection within our Privacy Policy. Please read this Privacy Policy carefully to understand how Vinted collects and uses personal information related to your account and/or your use of the Services. By using the Services or providing information on this Platform, you agree to allow Vinted to collect, use, disclose, and/or process the content and personal information (if any) involved in your use of the Services, in the manner described in this Privacy Policy.

2.2 Users who hold third-party personal data by virtue of using the Services (hereinafter referred to as "Recipients") agree to: (1) comply with all applicable laws and regulations regarding the protection of personal information; (2) allow the user whose personal information has been collected by the Recipient (hereinafter referred to as the "Disclosing Party") to request the removal of his/her information from the Recipient's database; and (3) allow the Disclosing Party to review the specific data collected by the Recipient. In the circumstances described in points (2) and (3) above, compliance shall be effected in accordance with applicable laws and regulations.

3 Limited License

3.1 Vinted grants you a limited and revocable right to access and use the Services, subject to the terms and conditions set forth in these Terms of Service. All proprietary content, trademarks, service marks, brand names, logos, and other intellectual property displayed on this Platform (hereinafter collectively referred to as "Intellectual Property") are the property of Vinted and/or the respective third-party owners identified on the Platform (where applicable). We do not grant, directly or indirectly, any right or license to any party accessing this Platform to use or reproduce any such property; nor may any party accessing this Platform claim any right, title, or interest therein. By using the Services, you agree to comply with all applicable laws protecting the copyrights, trademarks, service marks, and other intellectual property rights pertaining to the Services, this Platform, and its content. You agree not to copy, distribute, republish, transmit, publicly display, publicly perform, modify, adapt, lease, or sell any part of the Services, this Platform, or its content, nor to create derivative works based thereon. Furthermore, without our prior written consent, you may not mirror or frame any part of this Platform or its entire content on any other server, nor display it as part of any other website or platform. Furthermore, you agree that, without our prior written approval, you will not use any robot, spider, or other automatic device or manual process to monitor or copy our content (except in cases where search engines utilize standard search engine technology to direct web users to this Platform).

3.2 We welcome you to link to this Platform from your website, provided that your website/platform does not imply any endorsement by, or affiliation with, Vinted. You acknowledge that Vinted may, at any time and in compliance with applicable laws and regulations or the principles of good faith, suspend the provision of part or all of these Services.

4 Software

Any software that we provide to you as part of the Services is subject to the terms and conditions of these Terms of Service. Vinted reserves all rights not expressly granted herein. Any third-party scripts or program code linked to or referenced in the Services are licensed to you by the third parties that own such scripts or code (and not by Vinted).

5 Accounts and Security

5.1 Certain features of the Services require you to register an account and a shop. When registering an account and a shop, you are required to select a unique user identifier (hereinafter referred to as "User ID") and a password, and to provide certain personal information. If Vinted, in its sole discretion, determines that the User ID you have selected is unlawful, non-compliant, or inappropriate, Vinted reserves the right to suspend or terminate your account, or to freeze or close your shop. You may use your User ID and password to log in to other products, websites, or services for which we have enabled access, or with which we have an affiliation or partnership. Vinted has not reviewed any third-party content, functionality, security, services, privacy policies, or other terms governing such products, websites, or services. If you choose to do so, the terms of service applicable to such products, websites, or services—including their respective privacy policies (to the extent they differ from our Terms of Service and/or Privacy Policy)—shall also govern your use of those products, websites, or services. 5.2 You agree to (1) keep your password confidential and use your User ID and password solely when logging in; (2) ensure that you log out of your account at the end of each session on the website; (3) immediately notify Vinted in the event of any unauthorized use of your account, User ID, and/or password; and (4) ensure that your account information is accurate and kept up-to-date. You are obligated to safeguard access to your account; all operations and business activities conducted under your account (including, but not limited to, those within any sub-accounts you may have established under your main account) shall be deemed to be your own actions. You must assume full responsibility for all activities that occur under your User ID, store, and account, even if you were not the actual party performing such activity or usage. Vinted shall not be held liable for any losses or damages arising from the unauthorized use of your password or from your failure to comply with the provisions of this section.

5.3 The email address, contact details, and other information you provide during registration must belong to you and/or your authorized representative personally. Vinted reserves the right to verify the information you submit; you agree that Vinted may disclose, transfer, or grant access to the aforementioned information to third-party service providers for the purpose of verification. Failure to consent to such verification entitles Vinted to refuse to provide the Services to you.

5.4 Ownership of your Vinted account resides with Vinted, which reserves the right to manage your account in accordance with applicable laws and regulations or in adherence to the principles of good faith. You agree that Vinted may—in compliance with applicable laws and regulations or in adherence to the principles of good faith—terminate your account and User ID immediately (with or without prior notice to you), remove any content associated with your account and User ID from the Platform, revoke any subsidies previously granted to you, and cancel any transactions linked to your account and User ID. Vinted will also provide you with the reasons for such termination, including but not limited to: (1) failure to log in to and operate your account, or failure to operate a shop you have opened, for an extended period (exceeding 30 days or more); and/or if you have ceased business operations on the Platform for more than one year—including instances where no orders have been generated for one year (regardless of whether the account has been accessed); (2) violation of the terms and conditions of these Terms of Service; (3) the existence of substantial evidence confirming that the user has engaged in fraud, harassment, defamation, threats, insults, or other unlawful acts, or acts that violate the specific rules of the respective Vinted sites; (4) the possession of multiple user accounts or the creation of duplicate shops with improper or unlawful intent; (5) the seizure of funds or payments pursuant to a ruling by judicial or administrative authorities; (6) the submission of false or forged identity verification information by the user, which is subsequently verified as such; or (7) conduct detrimental to the commercial interests of other users, third parties, or Vinted (e.g., infringement of third-party intellectual property rights, fictitious transactions, abuse of free shipping or discount offers, etc.). Should you utilize your account for fraudulent, harassing, defamatory, threatening, insulting, or other unlawful purposes, we reserve the right to report such conduct to the appropriate law enforcement authorities without prior notice to you.

5.5 If your Vinted account is terminated due to serious violations, you are strictly prohibited from re-registering for a new account; should you be found to have re-registered, Vinted reserves the right to immediately suspend services and terminate the seller account in question.

5.6 You have the right to terminate these Terms of Service between yourself and Vinted at any time, in accordance with the methods mutually agreed upon by both parties. If a user wishes to terminate their account and shop, they may do so by providing written notice (please send an email to: vintedvip1@gmail.com, or contact your designated Account Manager). Even after your Vinted account and shop have been terminated, you remain solely responsible for all transaction-related matters—including any pending transactions (whether initiated prior to or following the termination), product shipments, and the settlement of product payments. You are required to notify Vinted only after you have promptly and effectively fulfilled and completed all outstanding transactions in accordance with these Terms of Service. Vinted shall not be held liable for any damages or losses arising from actions taken pursuant to these Terms.

5.7 You may utilize the Services and/or open an account or shop only within the countries authorized by us, as updated from time to time. 6 Your Commitments and Warranties

6.1 You warrant that you possess the full rights and/or authority to sell the products listed by you on the Shopee Vinted platform. Furthermore, such products—whether manufactured, assembled, produced, or otherwise provided by you—shall:

(1) Be of legitimate and lawful origin; unless otherwise explicitly stated in the product details, they shall be brand-new and authentic products;

(2) Strictly comply with all product warranties, specifications, designs, samples, performance standards, or other descriptions regarding the products that you have provided to the Vinted platform;

(3) Possess the functional performance that such products are expected to have; any defects regarding the functional performance of the products shall have been explicitly disclosed;

(4) Comply with all applicable laws and regulations—specifically, they shall not violate any laws or regulations currently in force in China or in the region where your store is located; they shall meet requirements for the protection of personal safety and property security, as well as environmental protection standards; they shall satisfy quality standards prescribed by relevant authorities; and they shall not infringe upon the rights of any third party (including intellectual property rights); and

(5) Be free from any third-party claims alleging infringement regarding any product, as well as any claims, demands, or legal actions concerning the manufacture, sale, distribution, or use of such products. Furthermore, Vinted shall not be subject to any third-party allegations of infringement arising from your sale of products on the Vinted platform.

6.2 Commitments and Warranties:

(1) You agree and warrant that Vinted shall not, by virtue of advertising, marketing, or promoting your products through any channel (whether on the Vinted platform or via other media), or by utilizing materials provided by you to advertise, market, or promote your products, directly or indirectly infringe upon the rights of any third party (including intellectual property rights);

(2) You commit and warrant that the materials provided by you may be utilized by Vinted for the purpose of advertising, marketing, or promoting your products (whether on the Vinted platform or via other media); furthermore, such materials shall not contain any defamatory content or other content that violates the laws and regulations currently in force in the region where your store is located, and they shall be complete, accurate, and reliable. You further commit that, should any errors be discovered in the materials provided by you, or should such materials require updating, you shall immediately notify Vinted thereof and promptly correct such errors or effect the necessary updates. You shall bear full responsibility for any content that you post or otherwise provide through your use of the Vinted platform and services, including—without limitation—the accuracy and reliability of such content, the assurance that you possess the requisite authorizations and that the content does not infringe upon any rights, as well as compliance with all applicable laws and statutory restrictions;

(3) You represent and warrant that you hold, or have been duly authorized regarding, all rights pertaining to the goods offered for sale; that you have obtained any and all formal consents, waivers, approvals, authorizations, registrations, licenses, or declarations necessary to ensure that Vinted is entitled to advertise, market, or promote the Seller’s goods; and you hereby authorize Vinted to utilize such content—within the scope defined by these Terms of Service—for the purpose of advertising, marketing, or promoting the Seller’s goods (whether on the Vinted platform or via other media).

...the rights described herein. This authorization is irrevocable, non-exclusive, royalty-free, and sub-licensable;

(4) You warrant that you shall collect, disclose, use, and process Buyer Information solely within the scope of the purposes stipulated in these Terms of Service. You shall not transfer any Buyer Information without the prior written consent of Vinted and the relevant Buyer; should you obtain Vinted’s prior written consent, you shall comply with all applicable laws and regulations, relevant Vinted policies, and Vinted’s reasonable instructions, and you—at your own expense—shall implement appropriate protective measures regarding such Buyer Information. You shall be held liable for any collection, disclosure, use, processing, or loss of Buyer Information caused by your subcontractors or service providers. You undertake to indemnify Vinted for any losses incurred by Vinted—including loss of goodwill—arising from your breach of the obligations set forth in this Clause, or resulting from your willful misconduct or negligence in the performance of such obligations. You shall bear, at your own expense, any costs or fees incurred by you, your subcontractors, or your service providers in complying with the obligations set forth in this Clause;

(5) You warrant that you possess the full rights and legal authority to enter into these Terms of Service and the actual sales contracts with Buyers, and that the terms thereof are legally binding and enforceable against you. You further warrant that you have duly completed the necessary market entity registration in accordance with the law and have fulfilled all tax obligations as required by law; furthermore, for any activities requiring specific administrative permits or professional qualifications under applicable laws, you warrant that you have duly obtained all such requisite permits and qualifications;

(6) You warrant that all information provided by you to Vinted, or provided by you to Buyers via the Vinted platform, is accurate, valid, and up-to-date. You undertake to uphold consumers' right to information and to fulfill your obligations regarding information disclosure. When listing products, you shall provide truthful descriptions—including, but not limited to, providing Buyers with true and complete descriptions of the products and services offered across all channels provided by Vinted (such as product description pages, shop pages, and the internal messaging system). Such descriptions shall cover, without limitation, details regarding shipping methods and costs, after-sales services, insurance coverage, basic product attributes, functions, packaging, condition, defects, pricing, etc.; you shall strictly refrain from making any false or misleading statements. (7) You warrant that the credentials, copies of authorization certificates, and other supporting documents you provide to Vinted are true, lawful, and valid. You further guarantee that the contact details you provide to Vinted (such as email addresses, telephone numbers, etc.) remain valid and accessible, ensuring that Vinted can establish contact with you via these channels. Furthermore, should any relevant credentials or information change, you undertake to promptly provide the updated details to Vinted. If you provide false or expired documents—or fail to provide documents in a timely manner—resulting in disputes or penalties imposed by relevant national competent authorities, you shall bear full legal liability arising therefrom. Should such actions cause losses to Vinted (including its partners, agents, employees, etc.), you agree to indemnify Vinted for all such losses; additionally, Vinted reserves the right to withhold payment of your sales proceeds until such time as these Service Terms are terminated.

(8) You warrant that all actions undertaken by you in connection with the execution and performance of these Service Terms—as well as any actual sales contracts entered into with buyers—do not violate any currently applicable laws, regulations, rules, orders, judgments, injunctions, or other requirements issued by courts or administrative authorities within the jurisdiction where your account is registered or where your store is established.

(9) You warrant that, in your use of this Platform and in the conduct of your cross-border e-commerce business activities as a seller, you will conscientiously comply with all applicable laws, administrative regulations, and relevant national provisions governing import/export and foreign exchange supervision and management within the specific sites involved in your operations.

6.3 The user license granted under these Service Terms shall remain valid until the termination of these Service Terms. Such license shall automatically terminate upon the occurrence of any termination events stipulated in these Service Terms, or in the event that you fail to comply with any of the terms or conditions set forth herein. Under such circumstances, Vinted reserves the right to unilaterally revoke the authorization granted to you; should such revocation result in actual losses to Vinted, you shall be liable for corresponding compensation. 6.4 You agree not to:

(1) Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, alarming, distressing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

(2) Violate any laws or regulations—including, but not limited to, regulations regarding import and export restrictions—or violate our "Prohibited and Restricted Items" policy or other relevant policies;

(3) Upload, post, transmit, or otherwise make available any content concerning minors without the express written consent of their parents or guardians, or use the Service to harm minors in any way;

(4) Use the Service to impersonate any third party, or falsely state or otherwise misrepresent your affiliation with any third party;

(5) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service;

(6) Remove any proprietary rights notices from the Platform;

(7) Cause, permit, or authorize the modification, creation of derivative works, or translation of the Service without the express permission of Vinted;

(8) Use the Service for the benefit of any third party or in any manner not permitted by these Terms—including, but not limited to, selling, transferring, or licensing the use of a Service account (in whole or in part) to a third party without Vinted's prior written consent;

(9) Use the Service, post item listings, or sell items in a fraudulent, unreasonable, false, misleading, or deceptive manner (including, but not limited to, providing false shipping information, delivering items that significantly do not match their description, refusing to sell after a transaction has been agreed upon, or maliciously canceling a large volume of orders);

(10) Register or simultaneously operate multiple user accounts in a manner that violates these Terms of Service;

(11) Use emulators, simulators, bots, or other similar hardware or software to access the Vinted Platform, open accounts, or access user accounts. (12) Manipulating the price of any item or interfering with the listing activities of other users;

(13) Engaging in any conduct that undermines the feedback or ranking systems;

(14) Attempting to decompile, reverse engineer, disassemble, or hack the Service (or any part thereof), or attempting to defeat any encryption technology or security measures implemented by Vinted regarding the Service and/or the data transmitted, processed, or stored by Vinted;

(15) Harvesting, collecting, and/or using any information regarding any individuals obtained through the use of the Service, including, but not limited to, any personal data or information;

(16) Uploading, emailing, posting, transmitting, or otherwise making available any material that you do not have a right to make available under any law or under contractual or fiduciary relationships (for example, inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements); Content that you do not have the right to provide;

(17) Uploading, emailing, posting, transmitting, or otherwise making available any content that infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party;

(18) Uploading, emailing, posting, transmitting, or otherwise making available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation;

(19) Uploading, emailing, posting, transmitting, or otherwise making available any material that contains software viruses, worms, "Trojan horses," or any other computer code, routines, files, or programs designed to directly or indirectly interfere with, manipulate, interrupt, destroy, or limit the functionality or integrity of any computer software, hardware, data, or telecommunications equipment;

(20) Disrupting the normal flow of dialogue, causing a screen to "scroll" faster than other users of the Service are able to type, or otherwise negatively affecting other users' ability to engage in real-time exchanges;

(21) Interfering with, manipulating, or disrupting the Service or servers or networks connected to the Service, or any other user's use of the Service, or failing to comply with any requirements, procedures, policies, or regulations of networks connected to this Platform;

(22) Taking or participating in any action or conduct that may directly or indirectly cause damage, disablement, overburdening, or impairment of the Service or servers or networks connected to the Service;

(23) Using the Service to intentionally or unintentionally violate any applicable local, state, provincial, national, or international law, rule, code, directive, guideline, policy, or regulation, including, but not limited to, any laws and regulations related to anti-money laundering or anti-terrorism. (regardless of whether such acts have legal effect);

(24) using the Service to infringe upon the privacy of others, to "stalk," or to otherwise harass others;

(25) infringing upon Vinted’s rights, including the infringement of any intellectual property rights and related acts of counterfeiting;

(26) using the Service to collect or store the personal data of any third party in connection with the prohibited acts and activities set forth above; and/or

(27) listing/selling content that infringes upon the copyrights, trademarks, or other intellectual property rights of a third party, or using the Service in a manner that infringes upon the intellectual property rights of others.

6.5 You understand that all content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content. This means that you (and not Vinted) are entirely responsible for all content that you upload, post, email, transmit, or otherwise make available via the Platform (including, but not limited to, any errors or omissions in any content). You understand that by using the Platform, you may be exposed to content that is offensive, indecent, or objectionable. To the fullest extent permitted by applicable law, Vinted shall under no circumstances be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of reliance on any content posted, emailed, transmitted, or otherwise made available by you via the Platform.

6.6 You understand that Vinted and its designees shall have the right (but not the obligation)—whether required by laws and regulations or in accordance with the principles of good faith—to pre-screen, refuse, delete, remove, or move any content made available via the Platform (including, but not limited to, content or information provided by you via the Platform). For instance, Vinted and its designees shall have the right to remove any content that: (1) violates these Terms of Service; (2) has been reported by other users; (3) is the subject of a notice of intellectual property infringement received by us, or is subject to other legal instructions requiring its removal; or (4) is otherwise objectionable to others. Furthermore, we may also block your use of the Service’s communication features (including, but not limited to, status updates, posts, messages, and/or chat rooms) in order to protect the Service or other users, or to enforce the provisions of these Terms and Conditions. You agree, understand, and have evaluated all risks associated with the use of any content, including but not limited to reliance on the accuracy, completeness, or usefulness of such content. Likewise, you acknowledge that you have not relied, and will not rely, on any content created by Vinted or submitted to Vinted, including but not limited to information found on the Vinted forums and all other sections of this website.

6.7 You acknowledge, authorize, and agree that Vinted may access, preserve, and disclose your account information and content if required by law, pursuant to a court order or an order from any government or regulatory authority having jurisdiction over Vinted, or if Vinted, acting in good faith and based on principles of integrity, deems such access, preservation, or disclosure reasonably necessary to: (1) comply with legal processes; (2) enforce these Terms of Service; (3) respond to claims that any content violates the rights of third parties; (4) respond to your customer service requests; or (5) protect the rights, property, or personal safety of Vinted, its users, and the public.

6.8 Should you fail to comply with the provisions of this Section, or commit a material breach of your promises and warranties as a seller, Vinted reserves the right to exercise its market management authority in accordance with these Rules. For the purpose of maintaining a healthy and sustainable marketplace and safeguarding the rights and interests of buyers, Vinted is entitled to conduct random quality inspections and authenticity verifications of products (including, but not limited to, acquiring products through test purchases or from consumers, engaging independent third-party quality inspection agencies or brand rights holders for verification, or instructing partner logistics providers to assist with inspections). When Vinted conducts periodic checks to verify whether products sold by a seller have a legitimate origin and are authentic, you are obligated to retain and produce documentation demonstrating the legitimate source of procurement for the relevant products. If Vinted has reasonable grounds to believe that an inspection has yielded an unsatisfactory result, or if a seller fails to provide the requisite documentation, Vinted reserves the right to impose restrictive measures upon the seller or their store. 6.9 If the brand you operate on the Platform encounters any of the following situations, Vinted shall have the right—in accordance with these Terms of Service—to delist the brand's products, and you shall be prohibited from continuing to operate said brand:

(1) The brand's products are proven by Vinted or a specialized third-party agency to have been manufactured by a producer lacking the necessary production qualifications, or fail to comply with mandatory national, local, industry, or enterprise standards;

(2) The brand is determined by Vinted or a specialized third-party agency to constitute an infringement upon—or to be likely to cause confusion or misidentification among consumers regarding—another party's trademarks, product names, packaging and trade dress, corporate names, product quality marks, etc.;

(3) During its operation on Vinted, the brand is proven to exhibit a high dispute rate, a high complaint rate, or low market recognition; or the average score of the brand's product descriptions falls significantly below the industry average, thereby severely negatively impacting the consumer experience—provided that no significant improvement is demonstrated within one (1) month after Vinted has issued a notification regarding such issues.

7 Violations of Our Terms of Service

7.1 Violations of these Terms of Service may result in a range of disciplinary actions, including but not limited to any or all of the following measures:

- Warnings: Wherein Vinted issues a reminder and admonition to a seller regarding their improper conduct, either verbally or in writing;

- Deletion/Delisting of product listings and/or restrictions on the ability to list products within the store;

- Seizure of prohibited items or products not permitted for sale on the Platform that are contained within orders;

- Revocation of any subsidies previously granted, such as shipping subsidies;

- Restriction of account privileges;

- Freezing of account funds;

- Criminal prosecution;

- Civil claims for relief, including but not limited to claims for monetary damages and/or applications for injunctive relief.

7.2 If you discover that any user of this Platform is engaging in conduct that violates these Terms of Service, please contact vintedvip1@gmail.com.

8 Reporting Intellectual Property Infringement

8.1 Users act as independent individuals or business entities and have no affiliation with Vinted. Vinted does not serve as an agent or authorized representative of any user, nor does it hold or possess ownership title to any of the products listed on this Platform. 8.2 You agree to assume full liability for any failure to timely notify Vinted of, or update, your intellectual property (IP) evidentiary documents. You warrant that all evidentiary documents provided by you to Vinted are authentic, accurate, and not expired (i.e., you warrant that all IP evidentiary documents remain valid throughout the entire term of these Terms of Service). Should any dispute arise, or should you be subject to penalties by relevant national competent authorities, due to the aforementioned reasons, you shall bear full and sole liability. Furthermore, should such circumstances cause any loss to Vinted (including its partners, agents, employees, etc.), you agree to indemnify Vinted for all such losses.

8.3 If you are an intellectual property rights holder (hereinafter referred to as an "IP Rights Holder") or an agent legally authorized by an IP Rights Holder (an "IP Agent"), and you believe that your or your principal's intellectual property rights have been infringed, you have the right to submit a written notice—detailing the relevant facts of the infringement and providing prima facie evidence constituting such infringement—to: vintedvip1@gmail.com. You also have the right to request that Vinted take necessary measures in accordance with the law. For specific requirements regarding such written notices, please refer to Clause 8.7 below. Please allow Vinted a reasonable amount of time to process the information you have provided. Vinted will respond to your request as soon as is reasonably practicable.
